Terms of Service

Welcome to Ebipi, the app discovery platform operating at ebipi.com. By accessing or using the Ebipi Site and related Services (collectively, the “Services”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, please discontinue use of the Services.

1. Acceptance of Terms

These Terms constitute a binding legal agreement between you (whether an individual or an entity) and Ebipi. By accessing, installing, or using the Services, you acknowledge that you have read, understood, and consent to be bound by these Terms and any policies referenced herein. Ebipi reserves the right to modify these Terms at any time. We will provide notice of material changes where feasible. Your continued use of the Services after the effective date of any updated Terms will constitute your acceptance of those changes. If you do not accept the updated Terms, you must stop using the Services.

2. Intellectual Property

All materials made available through the Ebipi Site, including but not limited to text, graphics, logos, icons, images, user interface elements, and the underlying software and code (collectively, the “Ebipi Content”), are owned by Ebipi or its licensors and are protected by applicable intellectual property laws. The Ebipi name and logos are registered marks of Ebipi or its affiliates. You may use the Ebipi Content solely for legitimate purposes related to your use of the Services, and in a way that does not infringe the rights of Ebipi or any third party. Any other use requires prior written permission from Ebipi.

Third-party content displayed on Ebipi, including app listings, reviews, and sponsored content, is owned by its respective owners. Your use of third-party content is governed by the terms and policies of the respective third parties, and Ebipi disclaims responsibility for such content, its accuracy, availability, or quality.

3. Third-Party Links and Apps Hosted on Google Play

Ebipi functions as an app discovery platform that aggregates and references mobile applications primarily hosted on Google Play. Ebipi itself does not host, distribute, or control the apps listed on the platform. When you choose to view or install an application via Ebipi, you will be redirected to the Google Play Store (or its website) to complete the installation and to review the app’s terms and privacy policy.

Ebipi does not supervise or guarantee the content, reliability, or performance of third-party apps or Google Play services. The availability of apps, updates, pricing, and terms are governed by Google Play and the respective app developers. Ebipi disclaims liability for any issues arising from your use of third-party apps or services accessed through Google Play, including any data collection, security practices, or in-app content.

4. Disclaimer; Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITES AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. EBIPI DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. EBIPI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

IN NO EVENT SHALL EBIPI, ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES THAT RESULT FROM (i) YOUR USE OF, OR INABILITY TO USE, THE SERVICES; (ii) ANY THIRD-PARTY CONTENT, INCLUDING APP LISTINGS ON Google Play; OR (iii) ANY OTHER REQUEST OR CLAIM RELATING TO THE SERVICES. IN NO EVENT SHALL EBIPI’S AGGREGATE LIABILITY EXCEED THE GREATER OF USD 100 OR THE AMOUNT PAID, IF ANY, BY YOU TO EBIPI FOR THE SERVICES IN THE SIX MONTHS PRIOR TO THE CLAIM.

5. Changes to the Terms

Ebipi may modify these Terms from time to time. We will endeavor to provide notice of material changes through the Services or other reasonable means. Your continued use of the Services after the effective date of the updated Terms will signify your acceptance of those changes. If you do not agree to the modified Terms, you must stop using the Services.

6. Miscellaneous

These Terms constitute the entire agreement between you and Ebipi regarding the use of the Services, and replace all prior communications and proposals, whether electronic, oral, or written. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The failure by Ebipi to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
